It is just like the "LEAD PAINT" issue that comes up from time to time. Lead paint has been banned in the US for years now. I don't think you could find it or buy it if you wanted to. (Maybe if you special ordered it from China or something) Yet, people are constantly worried about having lead paint on toys and furniture. It has been proven that ANY finish on wood these days is "FOOD SAFE" once it has cured. If you want to be SURE of food safe finish on kitchen or cooking items that won't flake off into food just use mineral oil for a finish on wood.
By the way, I just read that plastic cutting boards harbor more germs than a wooden end grain cutting board will. Of course the down side to that is, you can put a plastic board into the dishwasher and that is a big no-no for any wooden board.
